This Royal Decree is due has been introduced in a national level and transposes partially the Directive 2002/91/EC on the energy performance of buildings related to the energy efficiency of buildings.

This RD is drafted in the exercise of the competencies which has to have the Spanish state about the coordination and general planning of the economic activity, environmental protection and about the bases of the energetic government.

This decree requires the qualification of buildings, and starts at the same time when is approved the Technical Construction Code in Spain, which mark the minimum qualities to be met by buildings in terms of demands for heating and cooling.

The Purpose of the measure

The main purpose of this legislation is establish the basic procedure that must satisfy the methodology to calculate the efficiency rating energy of buildings, with which the certification process begins, considering those factors that most impact have in energy consumption of new buildings or reform or rehabilitate in
a particular extension. It also sets the same technical and administrative conditions for certificates of energy efficiency projects and completed buildings.

This measure aims to promote a high efficiency building forcing architects and constructors to make good enclosures, and establishing a minimum quality of buildings.

The results obtained with this measure is that loads of heating and cooling have descend and with this the use of fuel and electricity in buildings. Most of new public buildings tries to get a better qualification and also renamed private promoters.

But this measure has no mention about DHC systems because of the absence of it in Spain but in the specifications for the software to certificate and qualify with include DHC systems.

The only quotation to DHC systems of this Decree:

“ The scope of the software, both the reference one as the alternative one must include the following aspects:

…

a) Thermal installation in buildings (heating, cooling, ventilation and domestic hot water) and DHC systems including the pipe and conducts isolation characteristics.”

The impact of this measure in DHC is positive due to the qualification of a building connected to a DHC network increase it in a very high way.

But have no other impact in DHC.

The impact this legislation can have in DHC systems is only based in the idea of having a good qualification in the buildings connected to this with the objective of receive a subvention from the national energy agency (or regional depending on the region).

It has not a very high impact because the legislation is far from the economic targets of private constructors and energy services companies.

Effectiveness of the measure

By the moment, no DHC network has been constructed driven by this legislation.

The Royal Decree 616/2007 is to incorporate at the national Spanish legislation the Directive 2004/8/EC and to unify and summary all the legislation referred to cogeneration.

This is also included in the policy framework which tries to stimulate the use of renewable energies and the profit of the waste heat product of some installations.

With these installations the main idea is reduce the emissions and loses in the electrical network. It also wants to diversify the supply of energy and increase the independence of foreigner sources.

The Purpose of the measure

The objective of this Royal Decree is the creation of a framework to foment high efficiency cogeneration based in the demands of heating and the saving of primary energy increasing the energy efficiency and improving the security of electrical energy supply.

This RD foresee the analysis and evaluation of the national potential of high efficiency cogeneration and the barriers of this, also the measures needed to facilitate the access to the network to the units of cogeneration.

The main idea of this legislation is facilitate the existence of a law that allows streamlining of procedures to the completion of DHC plants and clarify the roles of each of the parties involved in the process.

This is a preview law to another one with gives the patterns to legalize installations of cogeneration giving step by step how to connect to electrical network and the conditions the cogeneration installation have to have.

This legislation has no impact in DHC systems because it has no mention of this kind of systems, offering no bonus for the installation of it.

The Royal Decree 661/2007 is a national law and appears just after the RD 616/2007 and adapts the guidelines of the Directive 2004/8/EC to quantify the efficiency of cogeneration plants with determined calculations and sets values for technologies efficiency. It includes also the terms to subsidize the sale of electric energy generated with cogeneration and other renewable energies as solar photovoltaic, wind energy, sea energy, hydroelectric power stations, biomass...

It’s included into the energetic policy with the objectives of foment renewable energies and cogeneration, into the Spanish strategy of saving and energy efficiency (2005-2010).

The modification of the law tries to achieve the objectives of this Plan.

The Purpose of the measure

The main purpose of this legislation is to encourage the use of renewable energies and the profit of waste heat of process. How to encourage the sale of electricity is subsidizing the price of it.

The introduction of this legislation is motivated by a change in the bonus scheme for the sale of electricity. In this scheme bonus for cogeneration increases.

The idea of encourage the production of electricity in this way is to increase the distributed generation of electricity reducing the use of fossil fuels and the energy loses in the distribution network.

In Spain this legislation has had an important influence taking into account that it has coincided with a change in the constructor sector and in the legislation promoter of solar photovoltaic plants.

This reasons made that investors look for other opportunities and it has become a good one.

There is pendent a revision of this Decree because companies which try to cogenerate with biogas have a very low bonus for the sale of the generated electricity. So the Biogas Spanish Association is pressing the administration to revise it.

The impact of this legislation in DHC is very important and it is increasing day after day. It doesn’t affect directly over the DHC systems, but has to be taken into account in the viability process (depending on the power of the station, the bonus increases or not), but it has a wide range because the maximum bonus reach to the 50 MW.

Nowadays there are many more urban planners considering the introduction of DHC or DH in new urban development as a result of studies of viability made for energy services companies which want to include this in new urban areas because of the high economic profitability of the combination of this technologies.

So the main impact this measure has had in DHC market has been so high to the current dimensions of it. The most influence of it is on the planning phase (according to the mention that over the 50MW of power the bonus decreases).

Effectiveness of the measure

There are some current planned projects of DHC with cogeneration.

One of this is in an existing neighbourhood with 720 housing but it’s pending on the acceptation by the population and the energy services companies.

In new networks which don’t have an existing generation plant and no longer dimensions, the inclusion of cogeneration is imminent.

PANER – National Action Plan in Renewable Energies

National Action Plan in Renewable Energies is currently in elaboration process and therefore the energy scenario for the year 2020 and growth targets for each of the renewable technologies during this
period can be reviewed.

The only draft of this plan is the first report done by each country in agreement with the stipulated by EU im the article 4.3. of Directive 2009/28/CE, of 23th April of 2009 related to the use of energy from renewable energy sources.

“According to a first estimate on the expected of renewable energies in Spain until 2020 made to the edit of this report, the contribution of renewable energy to final consumption of gross energy passes from 10.5% in 2008 to 22.7% in 2020 compared to Spain target from 20% in 2020.
As an average estimation is expected that in 2012 the participation of renewable energy would be of the 15.5% (compared to the indicative value provided in the indicative trajectory of 11.0%) and in 2016 from 18.8% (compared to 13.8% projected in the path).”

Until the final document of it we cannot describe the solutions Plan is going to do.

The Purpose of the measure

The increase of the renewable energy to the electricity generation decreasing the CO2 emissions with a target values to 2020.

Eligibility Criteria

All the electrical generation process, also the decrease of energy consumption and energy loads.
