Law No. 325/2006 regarding public heat supply service This law regulates the specific activities of the public service to supply heat used for heating and domestic hot water preparation, namely generation, transmission, distribution and supply heat in a centralized system, under efficient and qualitative standards, aiming to achieve optimal use of energy resources and environmental protection compliance. The provisions of this law applies to public DH systems established and organized in the villages, towns, municipalities and counties of all sizes. Law No. 51/2006 – Public Utilities Service Law The Law is stipulating the unitary legislative and organisational framework, the specific objectives, competencies, attributions and instruments needed for establishing, organization, administration, operation, monitoring and control of public utilities service operation. Regulation issued by Romanian Government on July 20th, 1994 regarding supply and use of heat This Regulation establishes the relationship framework for producers, distributors, consumers and sub-consumers of heat distributed by centralized supply systems and provides general conditions for supply and use of this heat produced in power plants, in boiler plants or in installations that uses renewable energy sources. Law No. 325/2002 - Thermal rehabilitation of the existing dwellings and stimulation of heat saving This ordinance establishes the legal framework for the rehabilitation and modernization of buildings and installations related to heat in order to improve hygiene conditions and thermal comfort and reduce heat losses, energy consumption, maintenance costs for heating and domestic hot water, and reduction of pollutant generation, transmission and consumption Government Ordinance No. 22/2008 on energy efficiency and renewable sources promotion for use by final consumers The purpose of this ordinance is to create the legal framework for developing and implementing national energy efficiency policy ANRSC Order No. 48/2008 for approval of the framework heat supply contract The purpose of this Order is to amend the framework agreement providing heat to households and regulating the rights and obligations which they have both suppliers and consumers of thermal energy. Law No. 372/2005 – Energy Performance of Buildings The purpose of this law is to promote energy efficiency in buildings, taking into account outdoors climatic conditions and location, the interior temperature requirements and economic efficiency.
ANRE Order No. 4/2010 – regarding approval of bonuses reference values for electricity, the reference price for electricity and the reference price for heat produced and delivered in high efficiency CHP. The aim is to establish criteria and conditions required to implement support scheme to promote high efficiency cogeneration based on useful heat demand. Urgency Ordinance No. 18/2009 – regarding the improvement of apartment block’s energy efficiency The ordinance is covering the necessary works on building’s installation for heat distribution located in commonly owned parts of apartment buildings. Government Ordinance No. 36/2008 regarding establishing of local reference prices for heat supplied by DH to the population This ordinance is establishing local reference prices for heat supplied to the population through centralized systems, for the purpose of space heating and domestic hot water preparation. Government Decision No. 60/2008 regarding approval of the National Plan for allocation of greenhouse gas emission certificate , covering 2007 and 2008-2012 period Romania's Energy Strategy, 2007-2010 It provides general measures to achieve the objectives that cover the entire energy sector and energy sector-specific measures in order to increase energy efficiency. The Program for Romania's energy strategy includes short-term measures on the heat as follows: - "Transposition into national legislation of the provisions of Directive 2006/32/EC (Energy Services Directive) on energy efficiency at end-users and energy services; - Develop regulations on support schemes for investment in cogeneration production units for electricity and heat , energy production units using, and support schemes for cogeneration units with renewable using resources, etc..; - Law ensuring the facilities for private investors investing in upgrading DH systems that supply heat to population; - Law ensuring the facilities for the population to encourage the purchase, erection and use of heating and domestic hot water preparation by use of renewable energy (solar panels, heat pumps, wind generators, geothermal sources, etc..) - State promotion of investment programs and supporting local authorities regarding refurbishment and modernization of centralized heat supply to population; - Law ensuring the priority of DH to receive natural gas supplied from local production, including ensuring continuity in long-term supply for DH systems that uses cogeneration and others. The medium and long term measures are mentioning: - Reducing heating costs for households, to the value of than 10% of average gross income per capita; - Implementation of production units of electricity and heat cogeneration yields exceeding 80% correlated with Directive 2004/8/EC; |

Purpose of the Legislation |

The purpose of the whole framework is to promote and support both public heat supply sector and especially the cogeneration of electricity and heat sector
The main purpose of the mentioned legislation is to regulate the operation of the centralized heat supply to the population. Law aims heating systems throughout the country. Other purposes are to promote the efficient use of energy resources, promotion of high efficiency cogeneration, use of new and renewable energy sources as well as the rehabilitation and modernization of buildings and heating installations. Legislation also establishes a regulatory framework for activities in electricity and heat produced in cogeneration in the best use of primary energy resources in terms of accessibility, availability and supportability and compliance with safety, quality and environmental protection. The legislative framework in Romania contains laws and ordinances that directly support the district, along with ordinances that are specific to other fields, which indirectly regulates the heating and field. Legal framework for DH includes the following:
- Law 325/2006 regarding the public service of heat supply; - Government Decision No. 425/1994 - regulation for supply and use of the heat - Government Decision No. 219/2007 - promotion of cogeneration based on useful heat demand - Government Ordinance No. 36/2006 - establishing local reference prices for heat supplied by DH
Legal framework indirectly district consists of: - Law No. 13/2007 - electrical energy law - Law No. 372/2005 - energy performance of buildings - Government Ordinance No. 18/2009 - enhance energy performance of housing blocks - Government Ordinance No. 29/2000 - thermal rehabilitation of existing buildings and stimulation of heat saving.
Government Ordinance No. 22/2008 on energy efficiency and promoting final consumers use of renewable energy and Government Decision No. 1215/2009 establishing criteria needed to implement support scheme to promote high efficiency cogeneration based on useful heat demand, are measures to regulate DH systems based o renewables.
Most laws and ordinances that regulate the energy sector of Romania create the legal framework for promoting and implementing measures under the Romanian Energy Strategy.
